The purpose of this document is to establish a mutual agreement
between the each housing student and The Florida State University,
acting for and on behalf of the Florida State University Board of
Trustees, a public body corporate of the State of Florida with regard
to living in University Housing facilities.
The following terms and conditions of occupancy (hereinafter called "terms")
are made part of the rental agreement signed by the Resident on the housing
agreement.
PART I - GENERAL
1. USE OF DWELLING
- Residents shall use and occupy the dwelling unit for which they
have signed a rental agreement exclusively as a residence for themselves,
and for no other purpose, except as may be permitted by the Florida
State University (hereinafter called the University). For Alumni
Village residents, those residents and immediate family members
written on the application as living in the apartment at the time
of application must notify University Housing immediately if there
is any change in the composition of the household. Residents shall
comply with all laws and ordinances affecting the use or occupancy
of the premises and with all rules or regulations now or hereafter
prescribed by the University for the safety, comfort, and welfare
of the residents of the housing units.
- Conditions, terms, and rates as set forth in these agreements
may be altered by the University upon 30 days notice mailed, e-mailed,
or delivered to the residents.
2. LEAD-BASED PAINT DISCLOSURE
- In 1992 Congress passed the Residential Lead-Based Paint Hazard
Reduction Act (known as Title X), which directed the Environmental
Protection Agency (EPA) and the Department of Housing and Urban
Development (HUD) to require disclosure of lead-based paint and
lead paint before the sale or leasing of housing built before 1978.
Housing built before 1978 may contain lead-based paint. Lead from
paint, paint chips, and dust can pose health hazards if not managed
properly. Lead exposure is especially harmful to young children
and pregnant women. Before renting pre-1978 housing, lessors must
disclose the presence of known lead-based paint and/or lead-based
paint hazards in the dwelling. Lessees must also receive a federally
approved pamphlet on lead poisoning prevention.
Alumni Village was built in three stages beginning in 1959 and completed
in 1965. In compliance with this act this is to inform you:
1) University Housing has no
knowledge of the presence of lead-based paint or lead-based hazards
in Alumni Village ;
2) University Housing has no
reports or records pertaining to lead-based paint and/or lead-based
paint hazards in Alumni Village ; And
3) Upon check-in to Alumni
Village , you will be supplied with a booklet entitled Protect Your
Family From Lead in Your Home published by the United States Environmental
Protection Agency.
- Since Alumni Village was built before 1978 there may be lead-based
paint or lead-based paint hazards. Especially if you are pregnant
or have small children, you are encouraged to follow the precautions
suggested in the booklet named above.
3. TERMS OF PAYMENT
- Rent or other recurring occupancy charges are payable in advance,
without demand or billing, at the University Housing Office or
Student Financial Services on or before the first day of each calendar
month of occupancy, in the amounts specified on the assignment
invoice plus any surcharges. Charges for partial periods of occupancy
shall be computed on the basis of 1/30 of the monthly rate for
each day in such periods. Each month shall be considered as having
30 days for the purpose of rental computations. A full day's rent
is chargeable although occupancy may be for only a portion of the
day.
- Residents shall pay the rental and other occupancy charges from
the assignment date listed on the assignment invoice unless the
apartment is available and is occupied earlier, or from the date
keys are issued, if earlier; in such cases charges will be adjusted
to the earlier date. If the rent begins after the 20th of the month
the following month's rental charge must also be paid. Subsequent
rental payments must be paid for each full month thereafter in
advance. After the tenth day of each month, unpaid rental charges
are delinquent and an additional $10 late fee will be charged.
- Residents of Rogers Hall are required to pay $17.50 for a University
post office box each semester (payable at the beginning of fall
and spring semester). This rate is for the 2007-2008 academic year.
4. REFUNDS
- Unearned Rent: If occupancy is terminated at any time other than
the last day of the period for which charges have been fully paid,
unearned rent, less any amount due the University, shall be refunded
to the resident by the University, provided that the resident has
given the required notice of termination and the unit is accepted
by the University. Refunds shall be calculated on the basis of
1/30 of the monthly rent times the number of days remaining in
the period after the date of termination. Each month shall be considered
as having 30 days for the purpose of refund computation.
- Three to four weeks are required for processing refunds. If there
are any fees owed to the University, the refund will be applied
to the balance due.
5. UTILITIES ( Alumni Village Only). Apartments
are individually metered and the city utilities department will bill
the resident of each apartment.
6. TERMINATION OF OCCUPANCY
A. By the University:
(1) Except as indicated in 6.A.3 below, occupancy and use of dwelling
units may be terminated at any time by the University by giving not
less than 30 days advance notice in writing, delivered, e-mailed,
or mailed to a resident at his/her premises or firmly affixed to
his/her door.
(2) The University reserves the right to transfer resident within the apartment
housing units if necessary for maximum and best utilization of units as determined
by the University.
(3) Without limitation to the following, termination may be effected immediately
if:
(a) The resident defaults in the payment of rent and other charges when due;
(b) There is any violation of the Terms;
(c) The resident misrepresents any material fact submitted to the University
as required;
(d) The resident misrepresents any fact for which he/she has signed on the
Housing Agreement/Application for University Housing facilities and the assignment
invoice;
(e) The resident is not registered for the current term at Florida State University
as a fee-paying, degree-seeking student making reasonable progress toward obtaining
a degree; [Exception: Residents who are still bona fide students and have not
graduated may, based upon special requirements of their academic program or
special financial consideration, petition to retain their assigned apartment
for one semester during the school year (September through August) in which
they are not enrolled. Approval must be granted prior to the semester in which
non-enrollment is requested.]; Students who withdraw from the University within
a given term are no longer eligible for University Housing. The student must
vacate within 24 hours of withdrawing;
(f) The resident is suspended or expelled from the University;
(g) In the event that the University determines to discontinue occupancy in
all or any part of the apartment housing, the University reserves the right
to require a resident to move from his/her dwelling unit, and these Terms shall
be terminated in accordance with the provisions hereof;
(h) Apartment assignments may at any time be changed, canceled or terminated
immediately by the University in the interests of order, health, discipline,
maximum utilization of facilities or disaster after notice to the assignee
as is practical. Disregard for the rights, responsibilities and duties of others,
as well as the creation of circumstances which could jeopardize life, limb
or property, are conditions which are not acceptable in University Housing
and may be cause for termination of the Housing Agreement.
(i) The resident fails to maintain minimum standards of safety and health code
practices;
(4) If the University terminates occupancy and all rights of the
resident according to (a) through (i) above, it shall have the right
without further demand or notice from the institution of any legal
proceedings whatsoever, to re-enter and take possession of the premises
and remove all persons and property there from by suitable action.
B. By the Residents :
A. Occupancy and use of any dwelling unit may be terminated at any
time by the resident by obtaining, completing and delivering an official university
form entitled ‘Intent to Vacate' (not less than 30 days advance notice) to
the main office of Alumni Village or Rogers Hall. Failure to give the 30 day
notice may result in an assessment of monetary charges for the full 30 days.
If occupancy is to be terminated at the end of a term, the resident shall give
at least 30 days notice in writing on an Intent to Vacate form available at
the main office of Alumni Village or Rogers Hall.
B. Residents shall terminate occupancy no later than a date stated
by the University, advance notice of which shall be delivered to
each apartment unit. Once an intent-to-vacate has been processed,
changes to an earlier date will not be accepted.
C. When resident departs, the apartment will be inspected for cleanliness and
damage. When the resident departs in the middle of the month, rental charges
will be prorated. The resident will be billed for all labor, material and replacement
costs necessary to place the vacated apartment in proper condition for subsequent
assignment, reasonable wear and tear excepted. Rent continues until the key
is returned. Failure to return keys to staff at time of departure will result
in charges for labor and material to replace the door lock.
D. Immediately when any termination becomes effective, an occupant must quietly
and peaceably remove him/herself, his/her family/roommate and his/her property
from the premises and surrender possession thereof to the University. Upon
termination of occupancy, resident shall quit and surrender the premises, equipment,
and furnishings therein in good order and repair, reasonable wear and tear
excepted. Residents shall submit apartment units for inspection and acceptance
by the facilities manager or his/her representative immediately prior to termination
of occupancy. The University shall have the right, without further notice,
to dispose of any personal property abandoned on the premises or in the apartment
housing by the resident after the resident vacates the premises in accordance
with Section 705.18 Florida Statutes.
7. RESIDENT'S RESPONSIBILITIES
A. Aid in Maintenance: Residents shall assist
and cooperate with the University in the care and maintenance of
the premises, and shall report promptly to the main office of Alumni
Village or Rogers Hall any breakage, damage, or need for repair of
the dwelling unit, facilities or equipment therein. Residents SHALL
NOT ADJUST OR TAMPER WITH ANY MECHANICAL, ELECTRICAL, PLUMBING, OR
GAS FIRED EQUIPMENT.
B. Alterations by Residents: Residents shall make no alterations,
changes, repairs, remodeling, application of wallpaper or paint to the premises
or equipment therein without prior consent of the University. Residents shall
use no screws or nails on the premises. Residents shall not use padlocks, change
locks already in use, or use any locking device that is not University approved.
Individual security systems are not permitted.
C. Entry: The resident shall permit the duly authorized agent, employee
or representative of the University to enter without notice any part of the
dwelling unit during reasonable hours for the purpose of inventory, maintenance,
inspections, improvements or repairs to any part of such dwelling unit. The
student's personal property is not subject to search without express approval
of the student except when a reasonable belief exists that the apartment is
being used for a purpose that is illegal, there is disregard for the rights,
responsibilities and duties of others, or the creation of circumstances which
could jeopardize life, limb or property.
D. Public Areas: Residents are jointly responsible with other residents
for the protection, maintenance and care of public areas or equipment.
E. Transfers or Subletting Units: Residents shall not transfer possession,
lease or sublet the premises nor give accommodations to guests, boarders or
lodgers without express approval of the University.
F. Rubbish, Garbage, and Waste: Residents shall deposit garbage, rubbish,
recyclables and other waste in a manner prescribed by the University and laws
and ordinances covering the use of the premises.
G. The resident shall be responsible for the care and preservation
of all University-owned movable equipment, furniture and furnishings provided
in the dwelling and shall be responsible for these as prescribed by the University.
Transfer of furniture between apartments or removal from the unit is prohibited.
Beds may not be set up in the living room in Rogers Hall. The State of Florida
laws require annual physical inventory, therefore, the property must be available
in the location as shown on property records for such inventory.
H. Telephone Service (Rogers Hall Only): You have the ability to contract
for telephone and cable services. These services are contracted separately
by contacting the Office of Telecommunications. You agree to be responsible
for all charges associated with cable and telephone services.
I. Residents will be required to either move to another apartment
or vacate (Rogers Hall or Alumni Village ) entirely in case of roommate incompatibility.
J. Liability for Loss or Damage: The University shall not be liable
for damage to or loss of personal property, failure or interruption of utilities,
or unforeseen accidents/injuries. The University provides only liability for
damages or injuries caused by negligence on the part of the University or its
employees while working within the scope of their employment. Students are
strongly encouraged to secure their own health and personal property loss insurance.
K. Residents are responsible for knowing and observing the University's
regulations, policies and standards governing conduct and procedure.
L. In keeping with the policies of the university, all rooms are assigned
without regard to race, creed, or national origin.
8. INFORMATION REQUIRED BY THE UNIVERSITY Residents
shall submit to the University, upon request, signed statements setting
forth the pertinent facts concerning their household composition
and student status. The University may re-examine such information
periodically for the purpose of determining the right of continued
occupancy.
PART II - GENERAL REGULATIONS PERTAINING TO COMMUNITY WELFARE
In the interest of community welfare,
the following general regulations should be observed:
1. Automobiles and Motorcycles: Speed
limits on housing streets shall be observed as designated. Alumni
Village will adhere to Florida State University parking and traffic
regulations rule NO: 6C2-2.009 (copies available in the Alumni Village
Main Office or Parking Services). Because of the extreme fire hazard,
motorcycles, mopeds, or other gas powered vehicles must not be parked
inside apartments or in breezeways. Violators will be charged $25
a day until compliance is achieved. Recreational vans/buses, boats,
and trailers may not be parked in the Village. The Alumni Village
decal must be visible in the back window on the driver's side for
the vehicle to be officially registered for parking. Abandoned and/or
inoperable vehicles will be subject to Florida State University parking
regulations No: 6C2-2.009 which states "vehicles...abandoned
on campus, deemed as a safety hazard by FSU Public Safety or Environmental
Health & Safety,
or failing to display a current valid permit or decal shall be towed
away and placed in commercial or University storage. Towing and storage
charges and any appropriate university fines, will be borne by the
vehicle owner and must be paid before the vehicle will be released." No
car repair may be done on the premises. This includes the removing
and changing of vehicular fluids. An assessment of $25 per day will
be made for failure to comply with any of the above standards.
2. Boats, Boat Trailers, Hauling Trailers, Buses and Recreational Vehicle: Residents
may not store boats, boat trailers, hauling trailers or trailers of any sort,
buses, or recreational vehicles in housing areas. Residents must make their
own arrangements for storage and/or parking of these items outside of the housing
area.
3. Business: Residents shall not pursue any business on the premises.
4. Construction: No outdoor or indoor construction of any type is
allowed without prior written consent of the University.
5. Damages: Residents are responsible for the care of their apartment
and the furniture and equipment therein. Charges may be made for damages to,
or alterations to rooms, equipment or furnishings.
6. Disease: Residents will report immediately to the University any
infectious or contagious disease occurring within the apartment housing.
7. Disturbances: Residents shall not conduct or permit in their apartments,or
on University Property, loud parties or activities or in any manner create
disturbances which would cause annoyance or discomfort to other residents.
Residents will not permit premises to be used for illegal or immoral purposes.
8. Drugs: No illegal drugs or drug paraphernalia are permitted in
the apartments.
9. Fire Hazards: Residents shall permit no combustible material (this
includes candles and incense) to be kept on the premises and shall take every
precaution to prevent fires. Stairways and breezeways as well as screened ventilation
areas shall be kept clear of all items to allow for quick egress in case of
emergency. Screened balconies are to be used only for ventilation. They are
not to be used as storage areas and should be kept free of all items. A charge
of $25 will be assessed for locking or storing anything on or immediately adjacent
(within two feet) to gas, electrical or water meters or conduits from these
meters leading into the apartment at Alumni Village .
10. Firearms: Residents may not possess on University property firearms,
fireworks or any material which may be hazardous to the health or safety of
the other residents.
11. Guests: Guests shall not be permitted to remain an unreasonable
length of time (defined to be not more than TWO weeks during any academic semester)
and must be registered with the main office of Alumni Village or Rogers Hall
PRIOR to their arrival. Residents can only have current FSU students and immediate
family members stay at Alumni Village for extended periods of time to baby-sit
or housesit. Residents shall be held responsible for the actions of family
members and guests.
12. Heating: Residents SHALL NOT USE any additional equipment for
heating without prior written consent of the University.
13. Halogen Lamps: Halogen lamps are not permitted.
14. Laundry: Clothes shall be dried only in those areas designated
by the University. Residents shall not erect lines for drying clothing on breezeways
or within or adjacent to the apartment housing area. Laundry and dish washing
machines are not permitted in the apartment units.
15. Miscellaneous: Residents shall not shake, clean or hang any bedclothes,
rugs, mops, dust cloths, etc., from windows, on roofs,on fencing and any hand
rails, and shall not climb on roofs. Rugs are not permitted to be hung anywhere,
including clothes lines. Play equipment may not be attached to buildings, trees
or other University property.
16. Pest Control: All apartments will be treated unless the resident
provides documentation from a physician requesting an exception for medical
reasons.
17. Pets: Fish are the only pets permitted in Rogers Hall. The only
pets allowed in Alumni Village are fish and small caged birds (prior approval
from main office of Alumni Village is required of its residents). Fish tanks
must not exceed 50 gallons.
18. Premises: Residents shall maintain premises in a neat and orderly
condition. No refuse or litter such as loose paper, cans, bottles, etc., shall
be permitted to accumulate in and around the apartment or in breezeways or
screened ventilation areas. A charge of $25 per day will be assessed for non-compliance.
19. Refrigerators and Freezers: Additional refrigerators or freezers
are not permitted.
20. Signs: Residents shall display no signs, placards or banners
of any type in or about the premises.
21. Soliciting: Since solicitors or other sales personnel are not
allowed access to the premises except with permission from the University,
the residents are requested to notify the main office (of Alumni Village or
Rogers Hall) of violations of this rule.
22. Smoke Detectors: Smoke detectors may not be dismantled or rendered
inoperable. A fine of $50 will be assessed for violation of this policy.
23. Storage: At Alumni Village , no household or personal property
(including children's toys) may be stored outside of dwelling units. Residents
shall not store items on stairwell breezeways or in screened ventilation areas.
A charge of $25 will be assessed until the items are removed.
24. Television Antennae, Radio Aerials and Satellite Dishes: Residents
shall not erect television antennae, radio aerials or satellite dishes.
25. University Regulations: Residents are responsible for knowing
and observing University regulations and procedures as set forth in official
University publications.
26. Window Air Conditioners and Window Fans: Residents may not install
window air conditioner and window fans in any place other than the designated
area. In compliance with fire safety codes, fans are not allowed in kitchen
windows.
27. Drums or other loud musical instruments: Residents shall not play
drums or other loud musical instruments.
28. Children must be supervised at all times when using any outdoor area (playgrounds,
parks, breezeways, or in and around apartments) .
29. Violations: A charge of $25 per day will be assessed for any behavior
that violates the community standards set forth by the lease agreement or other
official University publication.
PART III - REPRESENTATIVE AND WAIVERS
Neither the University, the Housing managers, agents or
employees of the foregoing have made any representations or promises
with respect to any part of the premises or dwelling units other
than set forth herein. The failure of the University to insist, in
any one or more instance, upon the strict observance of any of the
Terms shall not be considered as a waiver or relinquishment of such
Terms in any other instances, but the same shall continue in full
force and effect. The University reserves the right to make such
other rules as may be deemed appropriate or necessary for the safety,
care and cleanliness of the premises, and for securing the comfort
and convenience of all residents.
The laws of the State of Florida shall govern this agreement for any action,
state or federal, arising out of, from, or as a result of this, agreement shall
be in Leon County, Florida.
